Terms & Conditions

1. Introduction These Terms and Conditions govern the provision of construction and repair services provided by Sunshine State Builders GC LLC (“the Contractor”), and apply to all contracts entered into with our clients. By agreeing to service from Sunshine State Builders GC LLC, you agree to be bound by these Terms and Conditions.

2. Services The Contractor will provide construction services as described in the service proposal or contract agreement (“Service Agreement”). Each Service Agreement will outline the scope of work, payment terms, and any other specific conditions related to the project.

3. Payment Payment schedules and terms are specified in each Service Agreement. The Contractor may require a deposit before commencing work. All payments shall be made as stipulated in the Service Agreement. Failure to make timely payments may result in cessation of work and accrual of interest on overdue amounts at a rate of 1.5% per month.

4. Cancellation Policy If the client cancels the agreed services after commencement or preparation for commencement, a cancellation fee of 10% of the total contract price will be charged to cover costs incurred by the Contractor. This fee compensates the Contractor for surveying, procurement, and partial labor costs that might have already been expended.

5. Additional Charges Additional charges may apply under the following circumstances:

  • Travel Expenses: Charges for travel required to perform services will be pre-agreed and documented.
  • Change Orders: Any changes to the scope of work requested by the client will be subject to additional charges. All changes must be documented and agreed upon by both parties in writing.
  • Restocking Fees: If materials cannot be returned or need to be restocked, a fee will apply.
  • Administrative Costs: Costs incurred for project management and administrative tasks may be billed if significant and beyond usual scope.
  • Legal and Professional Fees: If legal or professional consultation is required due to client action or inaction, fees may be passed to the client.

6. Liability and Insurance The Contractor maintains liability insurance and workers’ compensation exemption as per Florida law. The Contractor is not liable for damages beyond the coverage and limits of these policies.

7. Force Majeure The Contractor is not liable for delays or failure to perform its obligations under the contract due to circumstances beyond reasonable control, including natural disasters, severe weather, labor disputes, or unforeseen governmental restrictions.

8. Dispute Resolution Any disputes arising from or related to the services provided under these terms will first be attempted to be resolved through negotiation. If resolution cannot be achieved, arbitration or legal proceedings may be pursued.

9. Acknowledgment By signing a Service Agreement, the client acknowledges that they have read, understood, and agreed to these terms.

10. Modifications The Contractor reserves the right to modify these terms and conditions at any time. All modifications will be effective immediately upon posting on the Contractor’s website.
